Over the past six months, the Contra Costa Court has been brutally ruling against me because i refuse to follow court orders that infringe upon my fundamental parental and due process rights. In June of this year, my wife decided to file a DVRO with no evidence and decided to stop my FaceTimes visitations with our nonverbal special needs child.
Long story short; She had no business stopping my visitations and the DVRO had no changes to the visitations so I filed an ex parte to enforce the visitations and the court turned it down. I missed my Fathers Day visit because of the bullshit decision.
Weeks later, Facetime Visitations were allowed to continue but I still lost two weeks of visits. Two months later, i filed an update asking the court to issue punitive sanctions against my wife for knowingly stopping court ordered visitations.
The Judge did nothing. She said that the court already ruled on the continued Facetime visitations and that the orders I filed to enforce the orders were moot.
I pushed back. I pushed back hard. And this is a lesson to any pro se father face to face with a family court judge protected by judicial immunity and biased against fathers.
I reminded the Judge that, while she did rule on the continued FaceTimes visitation after that June DVRO Hearing, I had lost at least four visitations. The Judge did nothing to issue punitive orders But she added four FaceTime vists for the month of September which meant I got four makeup visitations time with my daughter. Three visits a week instead of two visits a week.
Once again, this is a lesson to fathers fighting to get access. If your partner tries to take that visitation time or cancels visits, file this orders and get makeup time. it’s worth the extra hearing, you’ll score points in the case because you’ll be on the right side of a court order and your child will get more time with their father.
Good luck to all those fathers out there fighting for that extra time. Don’t give up!
